Chicago Residential Tenants’ Rights Attorneys

Category: Legal / Law
Description
Law firm represents Chicago tenants in disputes with their landlords under the Chicago residential Landlord and Tenant Ordinance (“RLTO”). Chicago’s RLTO represents a powerful tool for tenants in their relationship with their landlords. In many cases, violation of RLTO by a landlord gives the tenant a right to minimum damages set by the ordinance and requires the landlord to pay the attorney fees and court costs incurred by the tenant in enforcing the provisions of RLTO. Here are some examples of violations of RLTO:
? Failure to give a receipt for security deposit;
? Failure to keep security deposit in segregated account;
? Failure to pay interest on security deposit at least once each 12 month rental period;
? Failure to return security deposit within 45 days after tenant vacates;
? Failure to notify tenant in writing of any code violations at property for which landlord has been cited in previous 12 months or of notice of intent of utility provider to terminate service;
? Collection or attempt to collect late charge in excess of $10.00 per month for first $500.00 in monthly rent, plus 5% per month of monthly rent in excess of $500.00;
? Retaliation by landlord for various tenant actions, such as complaints re code violations;
? Threatening to or actually ousting, dispossessing or interfering with the possession of tenant from his or her apartment without legal process;
